The man shouldn’t face charges since he was justifiably in fear for his life given the circumstances described. He was shot once before when he was the victim of a home invasion in 2002, so he has even more reason than the average person to fear being shot. Unfortunately for him the DA in Milwaukee County is an anti-gun, anti-self-defense Leftist Progressive who used Wisconsin’s “John Doe” investigation law to persecute and harass Pro Gov. Scott Walker Republicans with trumped up charges and predawn raids and home searches, so there is no telling what charges this guy may face. In most states, Wisconsin included, you are not allowed to use lethal force to prevent the theft of your car. However, if the car thief points a gun at you, or otherwise poses a credible and imminent threat to your life (like by trying to run you over or something) then that is different. Texas is the exception; there you can shoot to keep your car from being stolen just because (they used to hang horse thieves after all).

There have been thousands of car thefts already this year in Milwaukee, and one man says he refuses to become a statistic.
- MILWAUKEE —A Milwaukee man who was shot multiple times during a 2002 home invasion said he felt he had no choice but to start shooting at a thief who pointed a gun at him while his car was being stolen.
Still, Mario Dickens could face charges for opening fire outside his graphics and design company on Monday evening.
The 32-year-old's 2008 Cadillac was parked outside the office building near North 76th Street and West Good Hope Road, which also houses a gas station, when an employee alerted him that someone was trying to steal the car.
Dickens said he grabbed his gun, ran outside and didn't hesitate to defend himself when the car thief pointed his gun first.

"I see him look me in my eye. He was a light-skinned guy. (He) had dread locks (and) a white T-shirt. He looked me dead in my eye, and I see him lifting his hand up to shoot, and I started firing at him," Dickens said. "I shot three times. Two hit the car and one hit the gas pump."
Dickens called police and posted about the incident on Facebook. A friend later helped find Dickens' damaged car behind an apartment building on the 6900 block of West Mill Road.
Police said Dickens has been ordered to the District Attorney's Office for firing his gun. Dickens said he refused to become another statistic.
"I was just trying to protect my life. I was scared for my life," he said.
No one was in custody in connection with the vehicle theft as of Tuesday evening, police said.
The number of stolen cars in Milwaukee is down compared to last year, police said. More than 3,300 vehicles have been stolen so far this year compared to more than 3,500 at this same time in 2015.
