District Attorney: Colorado Springs burglary shooting was justified

COLORADO SPRINGS, COLO. -- Authorities say the fatal shooting that occurred
during a burglary in western Colorado Springs early Sunday morning was
justified.

Eduardo Gonzalez-Ortiz, 32, of Colorado Springs was killed in the shooting
just after midnight in the 2900-block of West Colorado Avenue.

The Fourth Judicial District Attorney's Office said their investigation
found a 59-year-old resident of a home in that area was awakened by the
sound of an intruder. While investigating the noise, she heard the sound of
breaking glass and saw someone pushing in the window blinds and beginning to
crawl in through a broken window.

Although she warned the intruder to stop and told him she had a gun, the
intruder continued to enter the home, the investigation found. Even after
the woman fired a warning shot, the intruder continued crawling into the
home. The resident later told police that when the warning shot failed to
stop the man, she feared for her life.

The woman then fired at the intruder, striking him once. The intruder fell
back onto the ground outside the window.

The woman immediately called 911, and police responded. Gonzalez-Ortiz was
taken to a hospital, where he was pronounced dead.

The district attorney's office said the Colorado Springs Police Department
investigated the scene and found physical evidence that corroborated the
resident's version of events.

The investigation also found Gonzalez-Ortiz had a criminal record for
burglary in Texas.

"Based on a thorough review of the evidence and subsequent investigation, we
have concluded that the resident acted reasonably and with proper
justification," the district attorney's office said in a statement. "The
District Attorney's Office will take no further action in this matter."
