He was selling bootleg cigarettes. Tobacco Kills! How can a person who peddles death by cancer, heart disease and emphysema expect leniency from the forces of justice? Furthermore, Thou shalt not cheat the government out of its tax revenue! The government is greedy for taxes and taxes arecollected at gunpoint, by force, as we see each and every day. As both Rush and Ben Shapiro pointed out, the police were under orders from the Mayor to crack down on cigarette smuggling, in no uncertain terms. Therefore the cops were not going to leave Eric Garner alone just because he said so. No way. It was delusional of Garner to imagine that they would . Besides Eric Garner had been arrested for selling "loosies"' (individual bootleg cigarettes) anywhere from 8 to 31 times before, so he knew the drill. He was a habitual offender after all.
The final lesson learned is that if you are in such poor health that you cannot "walk a block without pausing to rest", it would be a real bad idea to resist arrest by the police. You might die in the struggle, even if the police didn't intend to harm you. Really if New York City wants to prevent this sort of thing from happening again, it should stop taxing cigarettes so severely. Then there would be no incentive for people, especially sickly and disabled poor people like Eric Garner, to sell bootleg cigarettes and the police would be able to avoid getting into violent confrontations with people pursuant to the enforcement of such a clearly unpopular law.
