Sam Dubose Case: Murder, or Reflexive Discharge?


The lesson that  these homeboys seem to be missing is that it is a real bad idea to frighten or startle people with guns. Apparently they engage in willful non-compliance, “dumb insolence” and excessive and inappropriate bravado simply because they get off on scaring the police. And what they succeed in doing is to scare the police into shooting them dead. Maybe they believe they are bullet-proof? In this case, the deceased’s foolish self-destructive behavior doesn't even qualify him for the Darwin Award since he already produced 13 offspring. Police officers are taught to have their gun out at the first sign of trouble. This doctrine has kept a lot of them from getting killed in recent years, compared to back in the 70’s and 80’s. Although sometimes this practice can lead to an unintentional discharge when the officer is startled by a suspect’s sudden and unexpected action. As when the suspect attempted to drive off without warning. After reviewing the video I think this is the case here. So it more likely a case of involuntary manslaughter rather than murder.
